The AARP on Friday filed an amicus brief asking a judge to uphold the Inflation Reduction Act, arguing that stopping the drug price negotiation program before it starts is not in the best interest of the public.
The brief, filed in the US District Court for the Southern District of Ohio, has to do with a lawsuit filed in June by the US Chamber of Commerce against HHS that attempts to walk back the Inflation Reduction Act, which granted the CMS the authority to negotiate drug prices with pharma companies. The Chamber of Commerce argued that the IRA violates the First and Fifth Amendments, calling the law an “unprecedented regime of price controls.”
