AARP, in amicus brief, argues that CMS negotiating drug prices is in the public interest

The AARP on Fri­day filed an am­i­cus brief ask­ing a judge to up­hold the In­fla­tion Re­duc­tion Act, ar­gu­ing that stop­ping the drug price ne­go­ti­a­tion pro­gram be­fore it starts is not in the best in­ter­est of the pub­lic.

The brief, filed in the US Dis­trict Court for the South­ern Dis­trict of Ohio, has to do with a law­suit filed in June by the US Cham­ber of Com­merce against HHS that at­tempts to walk back the In­fla­tion Re­duc­tion Act, which grant­ed the CMS the au­thor­i­ty to ne­go­ti­ate drug prices with phar­ma com­pa­nies. The Cham­ber of Com­merce ar­gued that the IRA vi­o­lates the First and Fifth Amend­ments, call­ing the law an “un­prece­dent­ed regime of price con­trols.”
