ADF asks SCOTUS not to take up mifepristone case as Danco, DOJ say arguments don’t hold up

The Al­liance De­fend­ing Free­dom, a con­ser­v­a­tive Chris­t­ian ad­vo­ca­cy group, on Thurs­day filed a brief ask­ing the Supreme Court to de­ny Dan­co Lab­o­ra­to­ries’ and the Biden ad­min­is­tra­tion’s re­quest to take up the Fifth Cir­cuit Court of Ap­peals’ de­ci­sion to tight­en re­stric­tions on the use of the abor­tion pill mifepri­s­tone.

The 63-page brief comes af­ter Dan­co Lab­o­ra­to­ries, which man­u­fac­tures mifepri­s­tone un­der the brand name Mifeprex, and the De­part­ment of Jus­tice filed briefs push­ing back on the ADF’s cross-pe­ti­tion last month, which took is­sue with sev­er­al as­pects of the FDA’s reg­u­la­tion of mifepri­s­tone.
