FDA to SCOTUS: Setting the mifepristone regulations clock back to 2016 is ‘unjustified’

US Solicitor General Elizabeth Prelogar has called on the Supreme Court to overturn an appeals court’s decision from August that would roll back some of the regulations around the abortion drug mifepristone.

Writing on behalf of the FDA just before the Thanksgiving holiday, Prelogar argued that the pharma industry “has warned that the court’s legal holdings would ‘upend’ a ‘settled regulatory scheme’ and ‘stifle pharmaceutical innovation’” as it would essentially represent a court overruling the FDA, and bring “outdated dosing and conditions that FDA has now determined are unjustified.”
