A federal judge on Friday upheld the Medicare drug price negotiation provisions of the Inflation Reduction Act, blocking an effort by the Chamber of Commerce to stop the negotiation processes before they start.
The judge’s decision came in response to a lawsuit filed by the Chamber of Commerce in an Ohio district court in June that argued the IRA violates the First Amendment and will result in government price controls on those drugs. Trump-appointed Judge Michael Newman of the Southern District of Ohio denied the Chamber’s request for a preliminary injunction but he did not dismiss the case as requested by the Biden administration.
