PhRMA joins Merck and BMS in suing over Medicare drug price negotiations

The phar­ma in­dus­try’s pow­er­ful lob­by­ing group is su­ing the fed­er­al gov­ern­ment af­ter a sting­ing de­feat on Capi­tol Hill last year and be­fore CMS can be­gin im­ple­ment­ing what PhRMA calls dam­ag­ing drug price set­ting that could harm fu­ture in­no­va­tion and pa­tients.

Filed in dis­trict court in west Texas to­day, along­side the Na­tion­al In­fu­sion Cen­ter As­so­ci­a­tion and the Glob­al Colon Can­cer As­so­ci­a­tion, PhRMA seeks to stop the en­force­ment of the price ne­go­ti­a­tions, which will be­gin in earnest this Sep­tem­ber, and the ex­cise tax, which it says is un­con­sti­tu­tion­al.
